—NOTICE OF PUBLIC HEARING—

HEARING DATE, TIME AND LOCATION: The Gunnison County Board of County Commissioners will conduct a public hearing WEDNESDAY, FEBRUARY 25TH, 2009 at 8:00 a.m. in the Board of County Commissioners Meeting Room, 2nd Floor, County Courthouse, 200 E. Virginia Avenue, Gunnison, Colorado, to hear public comment concerning an appeal of the County Planning Commission’s denial of an application for the placement of a permanent asphalt batch plant at the Hollenbeck Gravel Pit. The appellant is Paul Banks, Banks and Gesso, LLC.
PARCEL LOCATION: The land is located in the E1/4SE1/4 Section 11, T49N, R1E, N.M.P.M., approx. 6 miles east of the City of Gunnison, ½ mile east of Highway 50, off of CR 42 (Six Mile Lane)
APPEAL: On November 21, 2008, the Gunnison County Planning Commission denied the application of Hard Rock Paving and Redi-Mix, Inc., for the placement of a permanent asphalt batch plant at the Hollenbeck Gravel Pit. An appeal of the Planning Commission’s Decision was received on December 4, 2008. Pursuant to Section 8-103: Technical Modifications, Takings, Appeals and Exceptions of the Gunnison County Land Use Resolution, the Board of County Commissioners, at a regular Board meeting, on January 6, 2009, determined that they would hold a public hearing on the appeal.
PUBLIC PARTICIPATION: Interested persons are invited to submit verbal or written comments at the hearing, or to submit written comments by FAX (970) 641-8585, or by letter (to the County Planning Department, 221 N. Wisconsin, Suite D, Gunnison, CO  81230), so long as they are received by 5 p.m. the afternoon before the date of the meeting so that they may be submitted for the public record during the hearing.  A copy of the application and Planning Commission denial is available in the County Planning Department, 221 N. Wisconsin, Suite D, Gunnison, CO; additional information may be obtained by calling the Planning Department (970) 641-0360.

1:30 p.m.    Planning Commission work session/possible action in direction to Staff: Potential amendments of the Gunnison County Land Use Resolution:
    •    Definition of open space and requirements for setbacks related to open space
    •    Definition of “clustering”
    •    Section 1-110: Process for Designating Special Areas, particularly reviewing identification of need, the process, and fees for initiating the designation process
    •    Section 7-202: Sketch Plan Review Process Q., re: extension of time for submittal of a Preliminary Plan and Section 7-302: Preliminary Plan Review Process O. 1.: re: extension of submittal deadline for submittal of Final Plan
    •    Section 8-103: Appeals, including discussion of hearing process and required fees for initiation of appeal
    •    Sections 10-102: Locational Standards A. and 10-103: Residential Density A., continued discussion on locational and residential density standards
