Moss family drops wrongful death lawsuit in civil court

A Crested Butte man has pled guilty on charges of careless driving resulting in death, and has been sentenced accordingly in local district court a little more than a year after the fatal incident occurred.

Erik Klemme faced charges for his part in a three-vehicle accident on Highway 50 east of Gunnison that happened on August 28, 2019 and resulted in the death of two people. Donovan Moss, the driver of one car, was killed in the accident and his wife and passenger, Kaycee Moss, died later as a result of her injuries.

Klemme entered a guilty plea during his hearing in Gunnison County District Court on September 23, 2020. He was then sentenced to seven days in the Gunnison Detention Center, 18 months of unsupervised probation, $300 as a traffic fine, 240 hours of useful public service and completion of a driving course with the state patrol.

The case will remain open for 91 days from the sentencing date in the event that the Moss family files for restitution damages as a result of losing their two family members. A separate, civil case filed against Klemme earlier this year by Stephen Moss was dismissed by the plaintiff (Moss) on July 31, and no other civil cases associated with the case are pending at this time.
