Background:  The Applicants, Dolores G. LaVigne (“LaVigne”) and Moon Ridge Subdivision Association, Inc. (“Association”), are co-owners of water rights in and to Moon Ridge Wells A and B.  The Association owns water rights in and to Moon Ridge Well Nos. 1 through 9 in their entirety.  Through this Application, the Applicants seek findings of reasonable diligence regarding conditional water rights in Moon Ridge Wells A and B and Moon Ridge Well Nos. 1 through 9 (“Subject Water Rights”).  The Subject Water Rights are decreed for use within Moon Ridge Subdivision and within property owned by LaVigne.  The Applicants also seek to confirm that Moon Ridge Well A has been made fully absolute. 3. Information from previous decrees for the Subject Water Rights as to which findings of reasonable diligence are sought: a.    Original Decrees:  Case No. 95CW13 (“95CW13 Decree”) and Case No. 96CW218 (“96CW218 Decree”) Dates entered:  December 29, 1995 and July 18, 1997, respectively. Court:  District Court, Water Division No. 4 Diligence Decree:  Case No. 01CW273 (“01CW273 Decree”) Date entered:  May 28, 2003 Court:  District Court, Water Division No. 4 b. Moon Ridge Wells A and B. i. Location: 1. Moon Ridge Well A:  approximately 1,150 feet from the East line and 4,050 feet from the North line of Section 35, Township 13 South, Range 86 West, 6th P.M. 2. Moon Ridge Well B:  approximately 1,325 feet from the East line and 4,950 feet from the North line of Section 35, Township 13 South, Range 86 West, 6th P.M. ii. Source:  the Shallow Moraine deposits and/or alluvium of Washington Gulch. iii. Appropriation Date:  July 15, 1994 as to domestic use in Moon Ridge Subdivision (95CW13); September 30, 1996 as to domestic use for LaVigne’s 2 equivalent residential units (EQR) and irrigation of 0.51 acres under the central water system that serves the Subdivision and LaVigne’s property. iv. Amount:  0.2 cfs for each of Moon Ridge Wells A and B.  0.073 cfs of Moon Ridge Well A was made absolute for domestic and irrigation purposes in the 01CW273 Decree, and the remaining 0.127 cfs was continued as conditional.  Moon Ridge Well B remains conditional in its entirety. v. Use:  domestic use for 11 EQR, and irrigation of up to 0.51 acres from any one or both of the wells through the central water system.  Each EQR is allowed 2,000 square feet of irrigation under the 96CW218 Decree. vi. Depth:  approximately 100 feet deep c. Moon Ridge Well Nos. 1 through 9. i. Location: 1. Moon Ridge Well No. 1:  approximately 2,580 feet from the East line and 2,700 feet from the North line of Section 35, Township 13 South, Range 86 West, 6th P.M. 2. Moon Ridge Well No. 2:  approximately 2,160 feet from the East line and 2,700 feet from the North line of Section 35, Township 13 South, Range 86 West, 6th P.M. 3. Moon Ridge Well No. 3:  approximately 1,810 feet from the East line and 2,700 feet from the North line of Section 35, Township 13 South, Range 86 West, 6th P.M. 4. Moon Ridge Well No. 9:  approximately 2,120 feet from the East line and 3,210 feet from the North line of Section 35, Township 13 South, Range 86 West, 6th P.M. ii. Source:  the Shallow Moraine deposits and/or alluvium of Washington Gulch. iii. Appropriation Date:  July 15, 1994 iv. Amount:  0.033 cfs for each well v. Use:  domestic purposes for 9 EQR in Moon Ridge Subdivision vi. Depth:  approximately 100 feet 4. Integrated System.  The Subject Water Rights are part of an integrated water supply.  See 01CW273 Decree, Conclusions of Law at ¶ 5.  “When a project or integrated system is comprised of several features, work on one feature of the project or system shall be considered in finding that reasonable diligence has been shown in the development of water rights for all features of the entire project or system”  C.R.S. § 37-92-301(4)(b). 5. Outline of activity during the diligence period:  During the applicable diligence period, Applicants have taken steps to diligently develop the Subject Water Rights including, without limitation, the activities described in the list below.  This list is not intended to be inclusive and may be supplemented by additional evidence. a. Homes were constructed on an additional two lots during the diligence period, such that eight of the nine lots within Moon Ridge Subdivision have homes constructed on them, all of which are served by Moon Ridge Well A and the central water system.  Moon Ridge Well A and the central water system also serve LaVigne’s residence and barn under the decree entered in Case No. 96CW218. b. Applicants installed a new well pump on Moon Ridge Well A in December 2006 to enable Applicants to divert and place to beneficial use the full 0.2 cfs decreed to Moon Ridge Well A. c. Applicants made additional improvements to the central water system in September 2007. d. Applicants engaged in system planning, water rights planning and operations planning in support of the provision of water service to Moon Ridge Subdivision and LaVigne’s property. e. Applicants engaged the services of water resources engineering consultants for advice with respect to the central water system, which included the engagement of Schmeuser Gordon Meyer to complete an analysis of the central water system that serves the Moon Ridge Subdivision and LaVigne’s residence and barn.  f. Applicants maintained and operated a monitoring program for the collection of water quality data from Moon Ridge Well A, the data from which is used in connection with operation of the central water system and development of the Subject Water Rights. g. Applicants monitored new water rights applications and activities of other appropriators in order to protect the Subject Water Rights and the integrated system of which they are a part. h. Applicants spent in excess of $12,000.00 in connection with development of the Subject Water Rights, development of water system infrastructure and on water engineering consulting fees. i. Applicants have diverted and placed to beneficial use the entire 0.2 cfs Moon Ridge Well A water right for domestic use for 11 EQR and lawn and landscape irrigation within Moon Ridge Subdivision and within LaVigne’s property, pursuant to the decree in 96CW218. 6. Claim to Make Absolute.  Based upon the verified facts described in paragraph 5.i., Applicants request that the Court confirm and decree that the remaining conditional portion of Moon Ridge Well A in the amount of 0.127 cfs has been placed to beneficial use for domestic and irrigation purposes. 7. Land ownership information.  The Subject Water Rights are located on lands owned by Applicants, or upon the lands owned by the Association’s members, as follows: a. Separate sealed bids for the construction of a 75 foot by 120 foot; one story metal building will be received by Gunnison County Electric Association, Inc. (GCEA) at the above address until 4:00pm, local time, on June 18, 2009.
The work consists of construction of a metal frame shop and warehouse area including installation of a concrete foundation and floor, plumbing, heating, mechanical, electrical, exterior and interior finishes.
All contactors must be pre-qualified by the Association in order for their proposal to be accepted. Contact the Association for prequalification guidelines. The Association reserves the right to accept or reject any or all proposals.

HEARING DATE, TIME AND LOCATION: The Gunnison County Board of Commissioners will conduct a public hearing, June 16, 2009, at 8:50 a.m., in the Commissioners’ Meeting Room of the Gunnison County Courthouse to hear public comment concerning an application for a waiver of the Gunnison County Standards and Specifications for New Construction of Roads and Bridges for Taylor River Ranch.  A copy of the petition and supporting documentation can be reviewed at the Gunnison County Public Works Department at 811 Rio Grande, Gunnison, Colorado from 7:30 a.m. to 4:30 p.m. weekdays.
PARCEL LOCATION:  A parcel of land more specifically known as Taylor River Ranch Subdivision located within Sections 17, 20, 21, 28, 29 & 33, Township 15 South, Range 84 West, 6th P.M. and Section 8, Township 51 North, Range 2 East N.M.P.M., Gunnison County, Colorado.   The land is adjacent to the Taylor River Road.
PROPOSAL:  The waiver requests permission for the construction of two bridges along Wildwater Way across the newly constructed fishing stream, to be constructed to a width of 16 feet rather than the road width of 24 feet.
POSSIBLE ACTION Formal action may be taken on the waiver request at this meeting.

The GUNNISON COUNTY BOARD OF EQUALIZATION will meet on Monday, July 13, 2009 in the Commissioners Meeting Room at the Gunnison County Courthouse to review the assessment roll of all taxable real property located in the County.
The GUNNISON COUNTY BOARD OF EQUALIZATION will meet on Tuesday, July 14, 2009 in the Commissioners Meeting Room at the Gunnison County Courthouse to review the assessment roll of all taxable personal property located in the County.
Beginning also in July of 2009, the COUNTY BOARD OF EQUALIZATION will hear appeals from determinations of the Assessor with respect to the valuation of all taxable property. Thereafter at such times as may be necessary, until the closing of business on the 4th day of August, 2009, the COUNTY BOARD OF EQUALIZATION will hear appeals from determinations of the Assessor with respect to real and personal property.
Persons wishing to appear before the COUNTY BOARD OF EQUALIZATION must send the proper appeal forms to the County Administration Office, 200 East Virginia Avenue, Gunnison CO 81230 postmarked or hand delivered no later than 5:00 p.m. on July 15th, 2009 for real property and no later than 5:00 p.m. on July 21, 2009 for personal property.

12:30 p.m.    Outwest Guides, public hearing/no action, proposed commercial use and residential unit; located west of the Town of Marble at 5121 County Road 3
1:30 p.m.    Bear Ranch, continued public hearing/no action, public hearing will be continued to June 19, 2009 @ 11:00 a.m. in Gunnison;  request for the construction of a road to provide access to nine 35-acres tracts, located approximately 4.5 miles east of State Highway 133, north of County Road 12 (Kebler Pass)
1:45 p.m.    Upper Crystal River Special Geographic Area, work session/no action, request for the designation of the Upper Crystal River Valley Special Geographic Area for Natural Beauty, including  proposed specialized land use regulations.  Direction from Planning Commission to staff for recommendation to Board of County Commissioners
2:15 p.m.    Leave Marble
3:15 p.m.    Watson Flats Gravel Pit, Gunnison County Public Works/USFS, site visit/no action, request for the development of a new gravel pit on USFS property, to provide a source of aggregate for use on County and USFS roads and USFS campgrounds in the Kebler Pass area; located within Section 18, T13S, R88W, 6th P.M., generally at the 11.5 mile marker on County Road 12 (Kebler Pass), in the Watson Flats area of Kebler Pass
