The US Forest Service is seeking public input on Special Use proposals that have been received by the Gunnison Ranger District.
Outfitter and Guide Services
SUMMIT TRAIL ADVENTURES INC is requesting a temporary use permit for a wagon train trip on portions of BLM and USFS.  Route runs from Luders Creek Campground (Rio Grande NF) to the Old Agency Work Center to Los Pinos Pass (private property) to Powderhorn (private property) to Red Bridge (private property) to the intersection of BLM road 3009 and US50. The trip will use approximately 20 individuals using 6 covered wagons and 12 individual horse riders from June 21st – 26th, 2009. 
Recreation Events
BUTTE BOULDERING BONANZA (formerly known as Mile and Half High) is requesting a special use permit for a climbing competition near Skyland Boulders along the Upper Loop Trail, Crested Butte. The event is planned for August 29th.  An estimated 75 climbers are expected to participate.
COLORADO 500 CHARITY MOTORCYCLE RIDE is requesting a special use permit for a Non-Competitive, Charity Invitational Dual Sport Motorcycle Ride to be held from Basalt to Mt Crested Butte to Lake City to Ouray and back, including Silverton, Telluride and Snowmass Village, using approximately 500 miles of Forest Service and Bureau of Land Management roads and trails.  The event is planned for August 18th – 22nd 2009.  An estimated 300 riders are expected to ride in the 33rd annual event.  Approximately 100 riders will be on USFS/BLM trails at any given time
CRESTED BUTTE MOUNTAIN RUNNERS is requesting a special use permit for a series of fun runs that take place in the Crested Butte area from May to September.  Fun runs include Green Lake (Grin and Bear It), Strand Hill, Walrod Gulch, Washington Gulch, Irwin/Dyke, Gothic/Trails, Almont Triangle, and Snodgrass.  An estimated 200 participants may use Forest Service roads and trails during these fun run events between May and September.
EAST RIVER FREE TRAPPERS is requesting a special use permit for a weekend mountain-man rendezvous that takes place in Washington Gulch.  The rendezvous is planned during August.  An estimated 75 participants may attend. 
FAT TIRE BIKE WEEK is requesting a permit for a week long mountain bike festival that takes place in the Crested Butte area.  The bike week event is planned for June 2009 and will use approximately 200 miles of Forest Service roads and trails.  There will be approximately 165 individual participants.
GUNNISON TRAILS is requesting a special use permit for a bike race in the Crested Butte area.  Race begins at Avery picnic area goes to Schofield Pass then on FS Trail 401 to the Copper Trailhead and returns to Avery picnic area.  Intermediate riders would return from Schofield Pass to Avery picnic area.  This one day event would take place on Wednesday August 6, 2009.  An estimated 50 participants will participate.
GUNNISON VALLEY HEALTH FOUNDATION is requesting a special use permit for their GUNNISON/CRESTED BUTTE FALL COLOR CLASSIC.  This ½ Marathon begins at the Irwin cut-off over Ohio Pass towards Highway 135.  Aide stations will be located approximately every two miles along the route. Coordination will be conducted with Gunnison.  This one day event would take place on Sunday September 27, 2009.  An estimated 200 participants will participate.
In order to make an informed decision on the issuance of these permits, the Gunnison Ranger District is accepting comments on the proposals.  Comments must be received within 30 calendar days of the publication of this legal notice in the Gunnison Country Times.  Comments may be submitted in writing to the following address:  Gunnison Ranger District, Attn: Ray Rossman, 216 N. —NOTICE OF PUBLIC HEARING—
CONCERNING A LAND USE CHANGE PERMIT APPLICATION
FOR A FREESTANDING WIRELESS COMMUNICATION TOWER
TAYLOR PARK TRADING POST
400 ICE MOUNTAIN ROAD
N/2NW/4 SECTION 21 AND THE NE/4NE/4 SECTION 20,
TOWNSHIP 14 SOUTH, RANGE 82 WEST, 6TH P.M.

HEARING DATE, TIME AND LOCATION:  The Gunnison County Planning Commission will conduct a public hearing FRIDAY, MAY 15TH, 2009 at  10:00 a.m. in the Planning Commission Meeting Room, 2nd Floor, Blackstock Government Center, 221 N. Wisconsin, Gunnison, Colorado, to hear public comment concerning a land use change permit application.  The applicant is Four Corners Commnet, LLC. The landowner is Taylor Park Trading Post, Inc.
PARCEL LOCATION:  The proposed tower will be located at the Taylor Park Trading Post, 400 Ice Mountain Road, approximately 23 miles northwest of Gunnison, in Taylor Park.  The property is legally described as being located in the N/2NW/4 Section 21 and the NE/4NE/4 Section 20, Township 14 South, Range 82 West, 6th P.M.
PROPOSAL:  The request is for the construction and operation of a telecommunications facility, to provide wireless communication in the Taylor Park area.  The facility will include a 60’ freestanding monopole tower, with three cellular antennas, and two small cabinets at the base of the tower.
PUBLIC PARTICIPATION:  Interested persons are invited to submit verbal or written comments at the hearing, or to submit written comments by FAX (970) 641-8585, or by letter (to the County Planning Department, 221 N. Wisconsin, Suite D, Gunnison, CO  81230), so long as they are received by 5 p.m. the afternoon before the date of the meeting so that they may be submitted for the public record during the hearing.  A copy of the application is available in the County Planning Department, 221 N. Wisconsin, Suite D, Gunnison, CO; additional information may be obtained by calling the Planning Department (970) 641-0360.

APPLICANT: The applicant is Gunnison Energy Corporation, 1801 Broadway, Suite 1200, Denver, CO  80202.
PARCEL LOCATION: The location is on National Forest lands, within portions of Sections 8 & 10, Township 10 South, Range 90 West, 6th P.M. 
PROPOSAL: The request is for the upgrade of the existing Ragged Mountain Compressor Station, from 7 million standard cubic feet per day (MMSCFD) to 10 million standard cubic feet per day (MMSCFD), the replacement of an existing 4 inch gas pipeline with a 6 inch gas pipeline and the installation of 500 feet of two new 12 inch gas pipelines to connect to the Bull Mountain Pipeline. 
ACCESS:   Access will be from State Highway 133, via CR #265 and Forest Service roads.

—Request for letters of interest for participation—
in the Taylor Local Users Group Process
The Upper Gunnison River Water Conservancy District

The Upper Gunnison River Water Conservancy District is one of four signatories to the Taylor Park Reservoir Operation and Storage Exchange Agreement that was executed in August 1975. This forms the basis under which the release patterns from Taylor Park Reservoir are determined each year.
Each year, the UGRWCD seeks input and direction from local users of the Taylor River, Taylor Park Reservoir, and the main stem of the Gunnison River above Blue Mesa as to how the reservoir operations can best be optimized for stream fishery, reservoir fishery, irrigation, and rafting and boating purposes in the upper Gunnison basin.
The Board is seeking to appoint three citizen members to two-year terms on the Local Users Group from the following user groups:
1.    One member representing irrigation users along the Taylor River and Gunnison River main stem above Blue Mesa Reservoir, and
2.    One member representing wade fishermen along the Taylor River and/or Gunnison main stem above Blue Mesa Reservoir, and
3.    One member representing property interests along the Taylor River and/or Gunnison main stem above Blue Mesa Reservoir.
All persons appointed must be residents within the District and experienced and knowledgeable about river conditions along the Taylor and Gunnison Rivers. Selected members shall be notified in writing of their appointment. If interested in serving, please send to the District a letter of interest including the reason for your interest and the Local Users Group that you propose to represent. The Board will also consider letters of support or nomination from user groups of
interested individuals.

The following items will be discussed in a general work session format; the only action to be taken will be direction from the Commission for the staff to prepare amendment language or other documents to discuss for action at a future Planning  Commission meeting:
10:00 a.m.    •    Discussion of language/possible amendment of the Gunnison County Land Use Resolution’s locational and residential density standards (Sections 10-102.A and 10-103.A), exempting subdivisions with fewer than four residences.
    •    Discussion of language/possible amendment of the “adjacent parcels” language of the Land Use Resolution’s Residential Density standard (10-104.A.4), including the possibility of evaluating density of non-adjacent parcels in determining allowed densities of proposed subdivisions.
    •    Identification (and discussion as necessary) by Planning Commission members and/or staff of other areas of the Land Use Resolution that may require modification.
    •    Discussion about using matrices to construct Planning Commission Findings in Recommendation and Decision documents, summarizing each regulatory requirement, the evidence supporting a finding of compliance (including avoidance, minimization, and/or mitigation) or non-compliance, and the resultant finding

Impressions of the mining guy…

With the opportunity two weeks ago to meet with the chief executive of the Thompson Creek Metals Company, I thought it only fair to jot down a few impressions.
Kevin Loughrey is smart. You don’t get to be the CEO of a major worldwide mining company without being smart—and charming. By the end of my conversation, I thought he could have had Sue Navy signing a petition of support for a mine. To say the guy is smooth is an understatement. He’s a salesman. And a pretty good one.  Damn it.
I had half hoped he’d come in and just start spewing about how a mine is good for the economy but there’s a small price to be paid. He could have said it might screw up the water a tad and pollute the air a tich and turn just another mountain into a beautiful pile of rubble one rock at a time but it would all be worth it for the economy. He didn’t. Mine guys are different in the 21st century. He didn’t use the term “tree-hugger” once.
To hear him talk, all the mine will do is be close to invisible except when paying the local tax bill, which will be huge. I got the impression from Mr. Loughrey that Thompson Creek Metals Company will come in, drop a wad of cash into our collective pockets and no one will know they were ever here. Snake oil? Perhaps. But it doesn’t matter that much. Just the concept of a mine and recreation don’t mesh.
He asked me to keep an open mind. Okay.
But he also implied he understands his company will have to prove everything they claim they’ll do before they do it. You betcha. Welcome to the valley.
When he talked about how communities where Thompson Creek has a mine worry about the mine shutting down and leaving… as opposed to worrying about them coming… I certainly understand that. Communities change with a mine. To bring in 200 or 400 or 600 jobs dependent on mining, it is of course worrisome when a mine leaves.
There it is, though. The traditional profile of a mining community, including the old Crested Butte, isn’t hard to see. The term “Boom and Bust” is fairly common when applied to mining towns. Loughrey predicts this mine could have a life of six decades. There will be some times in those years that are busier than others.
Boom and Bust.
Last year the folks in Leadville probably felt a boom in their hearts when it was announced the Climax molybdenum mine would ramp up production. Those same people had to feel the bust in their soul just this past Monday when the mine’s owner laid off people and postponed that mine because the price of moly has plunged to $12 a pound.
This community has chosen to go in the direction of tourism to escape some of that boom and bust. While not totally steady, as we’ll probably see this season, a tourism economy doesn’t have the traditional wild swings of mining.
At times Loughrey seemed to diss second-home owners in the valley. Now, let’s not forget that those are the people who provide a lot of depth and money to Crested Butte. At least the current Crested Butte.
He’s not saying a lot that we haven’t heard before and I think most people who have chosen to live here understand that a tourist and second-home economy might not be perfect… but it’s pretty darn sweet most of the time and overall is healthier than a mine economy.
The worm on Mr. Loughrey’s hook is money.
More jobs. Different jobs. An increase in the tax base. Lower power bills. It’s a strong argument for some in a tough economic climate. I’m not sure he understands that a lot of people live here not for the money but for the place. And if the place changes too much too fast, what’s the point?
I went to school in southeastern Ohio. Mining country. I met mining families and became familiar with the mining communities next door. Good people and places. But the change to this valley would be huge. It is that change that is the problem. It’s not about the money or the people but the choice.
There are mining towns to move to now and looking at the Thompson Creek website, they aren’t places many of us would choose to live. Crested Butte in 2008 is a resort… by choice and by design. And just the idea of a mine at the resort probably keeps some people from coming here. It hurts the economic model that those people who have chosen to live here have spent years to mold.
Based on what Mr. Loughrey said last week, I anticipate his company to be in the mix here for a while. When he says they have to prove every positive impact of a potential mine, I agree. And he’s right about this community… Those living here won’t take what he says “on faith.” One other thing is likely as well—the process will not be short. It will be up to every one of us, whether for or against the proposed new use of Red Lady, to hold Mr. Loughrey and his company to that promise of proof for the duration.
I heard what Kevin Loughrey said: Thompson Creek is not afraid to be held to a very high standard of proof.
Now, hopefully my first impression is right… and he really is smart. Smart enough to understand that even the highest standards of proof may not be enough in this case.

CONCERNING A PROPOSED AMENDMENT
 TO THE GUNNISON COUNTY LAND USE RESOLUTION

HEARING DATE, TIME AND LOCATION:  The Gunnison County Board of Commissioners will conduct a public hearing TUESDAY, OCTOBER 21, 2008 at 8:50 A.M. in the Commissioners’  Meeting Room, 2nd Floor, Gunnison County Courthouse, 200 E. Virginia Gunnison, Colorado, to hear public comment concerning a proposed amendment to the Gunnison County Land Use Resolution. 
PROPOSAL:  The Gunnison County Planning Commission has recommended amendment of Section 3-105: Withdrawn and Inactive Applications, of the Gunnison County Land Use Resolution; the amendment would clarify that additional information regarding an application for a Land Use Change Permit must be submitted within six months after it is requested by the Planning Department, Planning Commission or Board of Commissioners.

CASE NO. 07CW116 Applicant: Murdie Homeowners Association/David Vanderhoofven, 6976 Robb Street, Arvada, CO 80004.  Amended Application for Ground Water Right, Surface Water Right, Storage Right, and Approval for Plan for Augmentation.  Background:  The Murdie Subdivision is situated in the Taylor Park area at an elevation of approximately 9580 feet, more specifically located in the NE1/4 of the NE1/4, Section 22, T14S, R82W, 6th PM Gunnison County, CO.  The Murdie Subdivision was originally platted by its developers in 1967 containing a total of 42 individual lots limited to 41 individual dwellings.  The Murdie Subdivision has historically been a seasonal use property with vacation cabins until recent years where a portion of lot owners have chosen to reside or vacation there on a year round basis.  It has derived its water supply from the Multhup Pipeline, Priority no. 657, adjudication date of October 28, 1965, case no. W-73, with an appropriation date of July 15, 1964.  The pipeline is decreed for the amount of 0.08 c.f.s. for stock and domestic purposes.  The Multhup Pipeline is located from whence the W1/4 corner of Section 23, T14S, R82W, 6th PM bears North 8°07” West, a distance of 2914.7 feet. (367890, 4296672).  The Multhup Pipeline, Priority no. 657 in the amount of 0.08 c.f.s., consists of a combination of a two and three in pipeline running a distance, from its point of diversion to the Murdie Subdivision storage tank, (absolute decree for the storage of 0.0614 acre-feet, case no. 85CW220), approximately 1 mile.  The pipeline drops down from its point of diversion to a point on Willow Creek where it supports a termination point with a shut-off valve and can be released directly into Willow Creek when not in use by the subdivision.  The water is turned on in May, depending on weather conditions, to serve the subdivision and shut off in mid October.  The operation of the pipeline to the subdivision is controlled by climatic conditions based on the high elevation of the pipeline and subdivision.  The infrastructure located within the Murdie Subdivision is placed at an approximate depth of 1.5 feet where operation of the water system is not possible due to the frost level, which exists in the range of 6 to 8 feet below ground surface.  Several homeowners who reside or vacation there on a year round basin have opted to drill individual wells based on the Pre. ’72 status of the Murdie Subdivision as no other water source is available during winter months.  The applicants are seeking a plan of augmentation for the purpose of drilling a community well to serve the subdivision replacing depletions from the Murdie Pond.  Water from the Multhup Pipeline was recently cited by the State Department of Health as being unsafe for human consumption and the Murdie H.O.A. is required to remedy the situation.  After detailed research, and considering the condition and length of the pipeline, the association made the decision to drill a well and operate the water system with the same infrastructure that is currently in place within the subdivision. The applicants acknowledge the need for a year round augmentation plan for future purposes, however, for now and for an indefinite time in the future, the subdivision will only be able to use the well during the same time frame as the Multhup Pipeline.  Given this, the applicants wish to keep the option open to allow for homeowners who choose to use the cabins during the winter months to have the ability to apply for and obtain an individual on-lot well.  Owner of land on which the well will be located:  The Murdie Well will be located on Lot 8, Blk, 3 of the Murdie Subdivision.  Owner is identified as Clarence D. Taylor ET AL, 202 Broken Arrow Dr., Sun City West, AZ 85375.  Owner has been notified by the “jdf290 1/06, Certificate of Notice” within 10 days after filing the application according to statute.  Application for a Ground Water Right: Murdie Well – NE1/4NE1/4 of Section 22, T14S, R82W, 6th PM.  100 feet from the north section line and 100 feet from the east section line.  Source:  Willow Creek, tributary to the Taylor River, tributary to the Gunnison River.  Appropriation Date:  08/31/2007.  Amount Claimed:  20 g.p.m or 0.044 cfs conditional and an annual appropriation not to exceed 16.08 acre-feet for use in up to 41 single-family dwellings most of which are used on a seasonal basis, and there exists 24 valid wells or well permits in place at present.  Application for Storage Right:  Murdie Pond – SW1/4NE1/4 of Section 22, T14S, R82W, 6th PM.  2,550 feet from the north section line and 1,382 feet from the east section line.  Source: Murdie Pond will be filled in priority by the Multhup Pipeline, Priority no. 657, adjudication date of October 28, 1965, case no. With an appropriation date of July 15, 1964.  The pipeline is decreed for the amount of 0.08 c.f.s. for stock and domestic purposes.  The Multhup Pipeline is located from whence the W1/4 corner of Section 23, T14S, R82W, 6th PM, bears North 8°07”, West a distance of 2914.7 feet.  Applicant seeks to add new conditional and absolute uses to the Multhup Pipeline, however, does not seek to enlarge the existing pipeline.  Source:  The Multhup Pipeline is tributary to Willow Creek, tributary to Taylor River tributary, to the Gunnison River.  Use:  Applicant seeks a conditional decree to fill the Murdie Pond in priority in addition to the existing domestic and stock of original decree in the amount of 0.08 c.f.s.  Applicant does not seek to increase the amount of the existing decree.  Appropriation Date:  06/10/2008.  Adjudication Date: 12/31/2008.  Applicant seeks an absolute decree for the irrigation to water up to 4 acres of lawn and garden within the subdivision.  A portion of the lot owners have historically used the Multhup Pipeline, as evidenced by the association’s minutes, to irrigate their lawns.  Date of Appropriation:  12/31/1986.  Adjudication Date:  12/31/2008.  Applicant seeks an absolute decree for fire protection. Date of Appropriation:  06/10/2008.  Adjudication Date:  12/31/2008.  Application for Approval of Plan for Augmentation:  Name of Water Rights to be Augmented:  This Plan of Augmentation will augment for all otherwise out-of-priority depletions from the Murdie Well and evaporative loss from the Murdie Pond.  Plan Assumptions and Source Data:  Applicant has made the following assumptions in the development of his plan for augmentation, which are based upon a report, included and made part of this application.  The demand for each residence is estimated to be 100 gallons per day (gpd) per person for a three and one-half person household.  The in-house demand for each has been calculated to average 0.033 acre-feet per month and total 0.40 acre-feet per year.  The total demand for 41 residences will be 1.34 acre-feet per month or 16.08 acre-feet per year.  Wastewater for dwellings is or will be treated by individual Disposal systems (ISDS).  In-house depletions are estimated to be 10% of demand and have been calculated to average 0.134 acre-feet per month and a total 1.608 acre-feet per year for the 41 residential lots.  Total Water Depletions from the Murdie Well have been calculated to be 1.608 acre-feet per year.  Note that these are conservative calculations as the proposed Murdie Well will only operate from May through mid October and several lot owners have individual household-use only wells already in place.  Applicant has sent to each lot and/or well owner within 600 feet, notice of its intent to file subject plan for augmentation.  Copies of these notices, attached Exhibit “A” are attached and on file with the Water Court. Potential Call.  Applicant realizes that calls upon Applicant’s diversions might arise on any stream reaches downstream of Applicant’s diversions.   Statement of Plan for Augmentation.  Augmentation for the Murdie Well serving domestic use for the 41 residential dwellings on the applicant’s property will be provided for by releases from the Murdie Pond decreed for a storage amount of 3.829 acre-feet with an appropriation date of June 10, 2008.  A piped outlet directly into Willow Creek by way of an existing channel will make releases from the Murdie Pond available on a year round basis as needed for any senior calls downstream.  The total consumptive use for the domestic use has been calculated to be 16.08 acre-feet for their total depletions, and 1.792 acre-feet for year round evaporative loss of the Murdie Pond, and 0.17 (5%) acre-feet in transit loss from the Murdie Pond outlet to Willow Creek, resulting in total annual depletions of 3.569 acre-feet.  The applicant acknowledges that augmentation water will be solely for applicant’s use.  Applicant has entered into a contract with the Upper Gunnison Water Conservancy District to purchase two acre-feet of water for out of priority depletions in the event of a Gunnison Tunnel call or a Redlands Power Canal call.

—PUBLIC NOTICE—
INVITATION TO BID

Colorado Division of Wildlife will be accepting bids for grazing of two parcels of pasture on the Miller Ranch State Wildlife Area located approximately 16.5 miles north of the City of Gunnison CO.  Grazing on the first parcel would begin on or around the fourth of August for a 45 day period and be capable of handling 100 head of cattle.  The second parcel would be grazed starting September 15 and continue for 30 days and carry 100 head of cattle.  Successful bidder is responsible for health and well being of livestock while on premises.
Bidders will be required to submit their sealed bid to the D.O.W. office at 300 West New York Ave. by August 1, 2008 5:00 P.M.
All bidders will be notified of results by end of business August 4, 2008.
Successful bid will be for this year only ending November 10, 2008.

—NOTICE OF GUNNISON COUNTY AND BLM ROAD CLOSURES—
Gunnison County, the Bureau of Land Management (BLM) and the United States Forest Service (USFS) have temporarily closed a number of roads to all motor vehicles to protect Gunnison Sage-grouse during their mating season and to prevent road damage during wet spring conditions. These roads were closed March 15 and will reopen on May 15, 2008. Copies of the closure list and maps are available at Gunnison County Public Works, 811 Rio Grande Avenue; Gunnison County Administration Office, 200 E. Virginia Ave; Colorado Division of Wildlife Office, 300 W. New York; and the Bureau of Land Management/USFS Office, 216 N. Colorado; Gunnison, Colorado. These closures apply to all motor vehicles. Do not park at the closures in a manner that blocks access through the closure gates. For additional information call Gunnison County Public Works at 641-0044; the Gunnison County Sage-grouse Conservation Coordinator at 641-7604; or the BLM at 641-0471. The cooperation of the public is required to successfully implement these road closures. The closures will aid in the preservation of the Gunnison Sage-grouse and may assist in reducing impacts on residents and visitors of Gunnison County from a possible Federal listing of the grouse under provisions of the Endangered Species Act. The public also should be aware of other closures in the Gunnison Basin that have been implemented to protect wildlife during this severe winter: The Colorado Division of Wildlife (CDOW) has implemented a Temporary Emergency Closure of all Hunting and Wildlife Related Activities, through May 15, 2008. The CDOW may be contacted at 970-641-7060 for additional information. The Bureau of Land Management (BLM) and the United States Forest Service have closed some public lands to all public use, including motorized and non-motorized uses, also through May 15, 2008. Contact BLM or the USFS at 970-641-0471 for specific information on these closures.
