CB South looks to update original POA covenant docs

Formal vote coming in late summer

The Crested Butte South Property Owners Association (POA) is planning for a community-wide vote this summer in which members will have the opportunity to weigh in on covenant amendments for the growing community. The original covenants date back to 1970, with updates made in 1996 and again in 2004.

The current process has been in the works since 2019 and would update the entire original document, which will be known as the Restated Declaration of Protective Covenants. In the meantime, the POA is hosting discussions on a monthly basis between now and August to address the proposed changes. Monthly topics will include lot appearance, animals, parking regulations, campers, building dimensions, short-term rentals and more.

Covenants will be in effect for everyone living in and visiting CB South, but only property owners can vote. The POA needs a majority of its 950-plus property owners to cast ballots for the vote to count, and 50 percent of all property owners plus one to vote in favor in order for it to pass. Officials say there is an assumption that not voting equals a “No” vote, which isn’t accurate, so the POA needs all ballots cast, for or against.

The last ballot question for CB South came in 2019, when members were asked to decide on increasing the capacity for commercial buildings from two to three stories in height. That measure did not attain a majority and failed. POA organizers are hoping for a different outcome to voter turnout this year.
